Encroachment is the wrongful construction of a building or improvement owned over the land another.  For example: neighbors tree branches hanging over your property line.

 

Be careful however, if a tree branches are hanging over your property line and you trim those branches you are the one liable if the tree dies. Therefore you are liable for removal of such tree.

In many circumstannces such encroachments end up in dispute and in court. Best approach is to negotiate a removal of branches with your neghbor. If your neighbor refuses to trim the branches, you are allowed to trim it yourself.
